Mailing Terms and Conditions
1. Acceptance of orders: The
customer agrees that Custom Postcards reserves the right to refuse
at any time to mail any copy, photographs, illustrations or artwork
of any kind that it finds to be an invasion of privacy, offensive,
inappropriate, obscene, libelous, or which in its sole judgment
is an infringement on a trade mark or trade name service mark or
copyright belonging to others. The customer also agrees to defend
and hold Custom Postcards harmless in any suit or court action against
Beard Custom Postcards for alleged damages and costs from mailing
such material.
2. Mailing list security: Customer's
mailing list(s), while in the possession of Custom Postcards, is
the exclusive property of the customer and shall be used only with
the customer's instructions. Customer's mailing list will not be
sold or offered for use to any other party, and Custom Postcards
will not utilize list for any other purpose. Custom Postcards assumes
no responsibility for the accuracy of lists purchased by customer
through a list vendor or personal client lists. Custom Postcards
shall provide reasonable and prudent protection against the loss
of a customer's list, in much the same manner that the customer
would itself. Custom Postcards assumes responsibility for replacement
of such lists in the event of loss by fire, vandalism, theft, or
other such causes, only if the customer has a duplicate list or
has the source material from which the list was compiled, and then
only to the extent of the costs involved in replacing the list cost.
Custom Postcards does not accept liability or responsibility for
compiling such lists nor for an intangible or special value attached
thereto.
3. Delivery schedules: Cards will not
be addressed unless payment, postage and approval have been received.
Custom Postcards has no control over U.S. Postal Service delivery
schedules and cannot guarantee when mail deposited will be delivered
by the Postal Service. All orders are accepted contingent to fire,
accident, acts of God, mechanical breakdowns or other cases beyond
its control. Custom Postcards does not accept responsibility or
payment for returned mail.
4. Errors in mailing: Custom Postcards
shall be liable only to the extent of remailing a correction or
corrected job as soon as possible to rectify the mistake, and allowable
damages shall be limited to the value of the work performed. In
no case is Custom Postcards liable for the loss of business or implied
damages.
5. Overages: The remainder of customer's
postcards not mailed through Custom Postcard's Mailing Services
will be returned via UPS unless otherwise specified by the customer.
6. Duplicate removal: Unless otherwise
instructed, Custom Postcards will not remove duplicate names and
addresses from your list. When instructed to perform duplicate elimination
services, 100% accuracy of removal cannot be guaranteed due to data
variances.
7. National Change of address updates:
U.S. Postal Service requires that all first class presorted mailings
comply with Move Update. Custom postcards assumes no responsibility

8. Reformatting: Custom Postcards accepts
several types of formats for data compilation for mailing services.
Any formats that are not compatible may be converted by our software
program. Customer will be notified of the need and cost to convert
and or format a database that is not mail ready before any work
is performed.
9. Delivery: In no fashion, whether
implied or verbally communicated by any staff member of Custom Postcards,
or otherwise, and under any condition, shall Custom Postcards be
liable for the delivery of mail after it has been delivered and
accepted at a USPS location, whether local to York, PA, or at any
other location. The delivery of the mail is in no way a responsibility
of Custom Postcards, as we have no control whatsoever, after it
has been accepted by the USPS delivery location.
